Hi there! At Happy Kids Nutrition Academy (“HKNA,” “we,” “us,” or “our”), we take your family’s privacy seriously. Because we teach kids and teens, we design our Services with extra safeguards to help protect minors’ information while still keeping learning fun and engaging.
This Privacy Policy explains how we collect, use, disclose, retain, and protect information from parents/guardians and students when you use our website and learning platform at www.happykidsnutritionacademy.com (the “Services”). We comply with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and follow COPPA-style protections for children, and we include additional disclosures for GDPR where applicable.
For more information on your rights under Canadian law, you can visit the Office of the Privacy Commissioner of Canada.
“Child” means a user under 13 (or another age where parental consent is required under applicable law).
“Parent/Guardian” means a child’s parent or legal guardian.
“Personal Information” (or “Personal Data”) means information about an identifiable individual, as defined under applicable law (including PIPEDA and, where applicable, GDPR).
“Services” means our website, course platform, and related online offerings (including quizzes, games, activities, and communications).
“Service Providers” are third parties that process information on our behalf (for example, platform hosting, payments, and background check providers).
Our Services are designed for students generally ages 8–18, with enrollment and payment handled by a Parent/Guardian.
Parents/Guardians can request to review the information we have about their child, correct it, delete it (subject to legal exceptions), or withdraw consent (where applicable), which may limit our ability to provide the Services.
We collect information in three main ways: (A) information you provide, (B) information your child provides while learning, and (C) information collected automatically.
Some jurisdictions define “consumer health data” broadly. Depending on what you (or your child) share with us, certain information could be considered health-related, such as nutrition preferences, dietary goals, or similar information.
We do not ask students to provide medical diagnoses, medical records, or information about medical treatments. However, if you choose to share information that may be considered health-related under applicable law, we will handle it as described in this Privacy Policy and in our Consumer Health Data Privacy Notice (which provides additional jurisdiction-specific disclosures and rights where required). If you have questions or would like to exercise any applicable rights related to consumer health data, please contact us using the information in the “Contact Us” section.
We disclose information only as needed to operate our Services and meet legal requirements.
We may share Personal Information with Service Providers who help us run our academy, such as:
These Service Providers are authorized to use information only as necessary to provide services to us (subject to their own terms where they act as independent controllers).
For families using ESA funds, we may share necessary enrollment and/or billing information with the relevant state/program authorities to support eligibility, documentation, and reimbursement/approval processes.
We retain Personal Information only as long as reasonably necessary for the purposes described in this Privacy Policy, including providing the Services, maintaining records, and meeting legal, tax, accounting, or regulatory requirements.
Upon verified request from a Parent/Guardian, we will delete a child’s account and associated data, subject to legal record-keeping requirements and legitimate business needs (for example, maintaining transaction records).
Our Services may include integrations and links to third-party sites or services (for example, embedded content, social media pages, or tools offered by our vendors). If you click a third-party link, you are leaving our Services, and the third party’s privacy policy will apply.
We recommend Parents/Guardians supervise children’s use of any third-party services.
We may use cookies and similar technologies to keep the Services working (e.g., authentication and session management), remember preferences, and understand how Parents/Guardians use our site so we can improve it.
We do not knowingly engage in interest-based advertising targeted to children under 13. If we use analytics tools, we aim to configure them in a way that is appropriate for a minor-focused educational service.
You can control cookies through your browser settings. Some features may not work properly if you disable cookies.
HKNA is based in Nova Scotia, Canada. Your information may be processed and stored in Canada or in other countries where our Service Providers maintain facilities (including the United States).
When information is transferred across borders, it may be subject to the laws of the destination jurisdiction. We take reasonable steps to help protect information in line with this Privacy Policy and applicable legal requirements.
Your rights depend on where you live and the laws that apply.
Parents/Guardians (and other individuals, as applicable) can request access to, correction of, or information about our handling of Personal Information. You may also withdraw consent, subject to legal and contractual restrictions.
You can opt out of marketing emails at any time by using the unsubscribe link (you’ll still receive essential service-related messages).
Please contact us using the details in “Contact Us.” We may need to verify identity and, for student-related requests, verify Parent/Guardian status.
We use administrative, technical, and organizational safeguards designed to protect information. This includes using industry-standard security measures available through our platform providers and limiting access to Personal Information to those who need it to perform their roles.
No method of transmission or storage is 100% secure, but we work hard to protect your information.
This Privacy Policy is intended to support compliance with:
This Privacy Policy also incorporates by reference any supplemental notices we provide, including our Consumer Health Data Privacy Notice (where applicable).
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. We will post the updated version on this page and update the “Last Updated” date. If changes are material, we will take additional steps to notify Parents/Guardians as required by law.

To help protect students and families, we may require background checks for instructors, educators, contractors, and/or employees who may interact with minors or access student accounts.
What information may be collected for background checks: Depending on the role and what is permitted by law, this may include identifying information (such as legal name, date of birth, address history), government-issued identification details, and other information needed to verify identity and eligibility.
What checks may be performed: Background checks may include, where legally permitted and role-appropriate, identity verification, criminal record checks, vulnerable sector / child-related checks, and verification of professional credentials or work history.
How we use background check information: We use background check information to assess suitability for roles involving minors, platform access, or trust-based responsibilities; to meet legal, safety, and contractual requirements; and to maintain a safe learning environment.
Service providers: We may use third-party screening providers to conduct these checks on our behalf. Those providers may collect and process information under their own privacy practices, and we limit what we share to what is necessary to complete the screening.
Retention: We retain background check information only as long as reasonably necessary for the purposes described above, unless a longer period is required by law or needed to establish, exercise, or defend legal claims. In some cases, we may retain a record that a check was completed (rather than the full report).
Your choices / consent: Where required by law, we will obtain appropriate consent from the individual being screened and provide any required notices or authorizations before initiating a background check.
If you are a U.S. resident, additional privacy rights and disclosures may apply depending on your state of residence. These state laws may, for example, provide rights to access, correct, delete, or obtain a copy of certain personal information, and to opt out of certain types of processing (such as targeted advertising), subject to exceptions.
Because our Services are designed for families and minors and we do not sell children’s personal information, certain state-law concepts (such as “sale” or “sharing” for cross-context behavioral advertising) may not apply to our practices in the way they do for ad-supported services.
How to exercise U.S. state privacy rights: You (as a parent/guardian, or as an account holder) can submit a request using the contact information in the “Contact Us” section. We may need to verify your identity and (for student-related requests) verify your status as the parent/legal guardian before we fulfill the request.
Authorized agents: Where required by applicable law, you may designate an authorized agent to submit certain requests on your behalf. We will take steps to verify the agent’s authority and may still need to verify your identity.
Appeals: Where required by applicable state law, if we deny your request you may be entitled to appeal our decision by contacting us at the email address listed in the “Contact Us” section with the subject line “Privacy Request Appeal.”
If you are located in the European Economic Area (EEA), Switzerland, or the United Kingdom, the General Data Protection Regulation (GDPR) (and UK GDPR, as applicable) may apply.
Controller: Happy Kids Nutrition Academy.
Legal bases for processing: Depending on the context, we process personal data:
Your GDPR rights: Subject to applicable conditions and exceptions, you may have the right to request access, rectification, erasure, restriction, data portability, and to object to certain processing. Where we rely on consent, you can withdraw consent at any time (this will not affect the lawfulness of processing before withdrawal).
International transfers: When personal data is transferred outside the EEA/UK/Switzerland, we take steps designed to provide appropriate safeguards as required by applicable law (for example, using contractual protections).
Supervisory authority: You may have the right to lodge a complaint with your local data protection authority.
